Third Party Liability
This is the concept where suit is brought against a person or entity, other than the employer, for injuries sustained by the employee. The workers’ compensation carrier gets a portion of what was paid to the injured employee returned from this third-party case under a formula known as the Franges formula. The injured employee can receive not only wage loss benefits but also compensation for pain, suffering, mental anguish, etc. from the third-party responsible for the injury.
