Dual Employment

Many employees have more than one job. In these situations, the employer in whose employment the injury occurred is liable for all of the injured employee’s medical, rehabilitation, and burial benefits. However, the weekly workers’ compensation benefits are apportioned as follows:

If the employment which caused the personal injury or death provided more than 80% of the injured employee’s average weekly wages at the time of the injury, the insurer is liable for all of the weekly benefits. However, if that employer provided 80-% or less of the injured employee’s wages, then the workers’ compensation benefits are apportioned between the employment that caused the injury and the State of Michigan Second Injury Fund.
